West Virginia Child Support Information

We regret to inform you that we are unable to work your case. The law of the land in West Virginia can be referred to as the Deadbeat Protection Act and represents the most egregious state law protecting deadbeat parents.

The state requires a Private Child Support Enforcement Agency to follow the guidelines of the Fair Debt Collections and Practices Act (FDCPA), which limits the number of times a person can be contacted about their child support matters as well as who we can speak to about the situation. The state of West Virginia has also limited the commission a private agency can take to 10% which would not begin to cover the costs to produce the kind of enforcement each case needs and deserves.

In addition, the state will not allow for a private agency to recover their fees if they hire an attorney to represent the custodial parent in court. This is the law of the state, West Virginia Code 48-1-307. Due to these requirements it becomes ineffective for a private agency to work cases from this state.

The state believes they know better than you how to enforce your child support order. If you feel this is wrong contact your State Senator or local Representative.

7% of a total of $768,488,015.001 of arrearages owed in West Virginia was collected by the WV CSE. 34% of West Virginia families do not receive their current child support.
