Who is in charge of enforcing a child support order?

The South Dakota Division of Child Support is a part of the South Dakota Department of Social Services. They have 7 field office locations and 1 satellite office through out the state.

Age of Emancipation

SDCL 25-5-18.1 A parent's duty to provide support does not end until the child reaches the age of 18, or until the child reaches age 19 if the child is a full-time high school student.

Statute of Limitations to enforce a child support order

SDCL 15-2-6 Actions on judgments must commence within 20 years after the date the last payment was due. See also SDCL 25-7-7.4.

Interest

SDCL 25-7A-14 Allows for interest to be added at the rate of 1% per month. See also SDCL 54-3-16.
