Who is in charge of enforcing a child support order?

The Montana Child Support Enforcement Division is a part of the Montana Department of Public Health & Human Services. They have a central office and then several field offices throughout the state that service several counties at each location.

Age of Emancipation

MCA 40-4-208(5) Duty to provide support terminates at the child's 18th birthday or graduation from high school, whichever is later. The support may continue until age 19 if still enrolled in high school, but not past their 19th birthday without an order from a court stating otherwise. See also MCA 40-5-201(2).

Statute of Limitations to enforce a child support order

MCA 27-2-201(3) An action to collect past-due child support must commence within 10 years of the termination of the support obligation or 10 years from a lump sum judgment or ordered support arrears, whichever is later.
